1. The Practice
These terms govern the relationship between Saen Suk Counsel ("the firm", "we", "us") and any person ("the client", "you") who engages our legal services or uses this website. Saen Suk Counsel operates from 312/4 Sukhumvit Road, Khlong Toei, Bangkok 10110, Thailand. We provide pension legal defence services, including assistance with survivor pension claims, disability pension applications, and long-term care pension coordination.
By contacting us, submitting a form on this website, or proceeding with an engagement, you acknowledge that you have read and understood these terms.
2. Scope of Services
The firm's services are described in detail on the Solutions page of this website and in the written engagement letter provided to each client before work begins. Our current service range covers:
- Survivor Pension Claim Support — review of entitlements, documentation, and claim drafting following the death of a pension holder (4,200 THB)
- Disability Pension Application — review, coordination with treating physicians, and application preparation for disability or incapacity claims (10,500 THB)
- Long-Term Care Pension Coordination — review of entitlements, applications for care-related supplements, and ongoing correspondence for families arranging elder care (14,000 THB)
Work beyond the scope described in the engagement letter may be agreed in writing at a separate fee. We will always inform you before undertaking work that falls outside the agreed scope.
3. Engagement and Instructions
A formal engagement begins when both parties have signed or confirmed in writing the engagement letter for the relevant service. Until that point, any preliminary conversations or written communications are provided as general information only and do not constitute legal advice.
Instructions given to the firm should be clear, complete, and provided in writing where possible. If you give us oral instructions, we may ask you to confirm them in writing. We act on the instructions of the named client only, unless you have authorised another person to give instructions on your behalf and informed us of this arrangement in writing.
4. Fees and Payment
Fees for each service are stated in Thai Baht (THB) and listed on this website and in the engagement letter. All fees are inclusive of the tasks described in the service scope and do not include third-party disbursements such as certified translation costs, official document fees, or courier charges, which will be agreed separately and invoiced at cost.
Payment schedule
A deposit of fifty percent of the service fee is due at the time of engagement. The remaining balance is due on completion of the matter or upon submission of the primary application, whichever occurs first, unless a different arrangement has been agreed in writing.
Late payment
Where payment remains outstanding more than thirty days after the due date, we reserve the right to pause work on the matter and, where necessary, to withdraw from the engagement after giving reasonable written notice.
5. Confidentiality
The firm holds all information provided by clients in strict confidence. We do not disclose client information to any third party without the client's written consent, except where required to do so by Thai law, court order, or the rules of the Lawyers Council of Thailand. This obligation of confidentiality continues after the matter is closed and after any termination of the engagement.
Clients are asked to treat information provided by the firm, including legal assessments and correspondence, as confidential and to avoid sharing it in ways that could compromise the matter.
6. Termination
Either party may end the engagement by giving written notice. If the client ends the engagement, fees for work completed up to the date of notice are due and payable. If the firm ends the engagement for reasons unrelated to the client's conduct, we will retain fees only for work demonstrably completed and will return any documents belonging to the client without delay.
The firm may end the engagement without notice where the client has provided materially false information, given instructions that would require the firm to act unlawfully or in breach of professional obligations, or failed to pay fees due after reasonable written notice.
7. Limitation of Liability
The firm's liability to a client in connection with any matter is limited to the amount of fees paid by the client for that specific matter. We are not liable for outcomes that depend on decisions made by pension authorities, courts, or other third parties, provided that we have carried out the work with reasonable professional care and within the agreed scope.
We are not liable for loss arising from instructions given to us in error, incomplete information provided by the client, or delays caused by third parties outside our control.

10. Governing Law
These terms are governed by the laws of Thailand. Any dispute arising under these terms, or in connection with an engagement, shall be subject to the non-exclusive jurisdiction of the courts of Bangkok, Thailand.
We encourage clients to raise concerns with us directly in the first instance. We take professional conduct seriously and will do our best to resolve any misunderstanding promptly and in good faith.
11. Changes to These Terms
We may revise these terms from time to time. The date shown at the top of this page indicates the most recent revision. The terms that applied at the start of your engagement with the firm are the terms that govern that engagement, unless both parties agree otherwise in writing.
